Abstract
For many, the breakdown of a family is a difficult and painful process. If a dispute is not handled well, the financial, psychological and emotional impact on children and adults may be immense.
The need to find fair, cost-effective and practical solutions which will withstand the test of time could not be greater. Yet, arguably, our post-LASPO system of family justice is in disarray, prompting many parties to navigate the adversarial system alone, sometimes with
disastrous results legally and personally.
Professional dispute resolvers must be able to deal with complex issues and assets and dynamic family structures. How can we ensure that they are equipped to do so, that disputes are resolved comprehensively and that couples and families can move forward with
their lives, emotionally intact? Is (a modified form of) mediation ‘the answer’ or are there others?
In a bid to begin to answer these questions, a new piece of empirical research will appraise existing approaches to Family Law dispute resolution and a new model which has been launched by His Honour Judge Stephen Wildblood KC and the Clinical Consultant
Psychologist, Dr Freda Gardner. The key features of the study will be outlined in the talk.
