Abstract

The issue of delay in public law children cases is a concern because of the uncertainty it creates for children and families and the burden it places on the public purse. An aim of the Public Law Outline (‘PLO’) was to introduce a ‘pre-proceedings process’ which would divert cases from court where appropriate and ensure that any necessary proceedings were conducted more efficiently. The Revised PLO established a 26-week target for the conclusion of proceedings but did not set one in relation to pre-proceedings.

In this article, the author summarises the qualitative and quantitative data that she and her research team collected in 2014 and 2016 about the operation of two regional protocols which aimed to complete pre-proceedings work within 26 weeks and considers the extent to which they have achieved their aims and contribute to better outcomes for families and children.
