Privatising fishing rights: The way to a fisheries wonderland?

Abstract

There has been a great deal of recent research proposing that that privatisation of sovereign fishing rights is a solution to overfishing. This paper examines the claims made by Costello et al. in the context of the UK fisheries and discovers a number of issues in the allocation of the UK's fishing rights to the private sector, these range from the potential de facto privatisation with no compensation to the public owner, to issues of legitimate expectation and human rights issues. The paper concludes that while privatisation may be appropriate there are a number of issues which need to be resolved to ensure a fair process of doing so.
