Abstract

The question addressed in this chapter is whether human rights law, as it is currently practised, adequately recognizes and reflects the complex interdependence of human rights and the environment. In particular, do human rights courts take sufficient account of the complicated ways in which individuals, communities and the environment are interconnected when making decisions in cases concerning the human rights impacts of environmental harm?
