Abstract

Corporate conduct can have devastating effects on the social, governance, and economic systems of states and regions. The drafters of the Malabo Protocol of the African Union opted to include corporate criminal liability as a mode of liability, thus making it possible for the proposed African Criminal Court to try corporations for international and transnational crimes. This chapter provides an overview of relevant aspects of the Malabo Protocol, notably the transnational crimes of corruption, money laundering, various trafficking offences, and the crime of illicit exploitation of natural resources. The brief discussion of the specific crimes is followed by a critical assessment of corporate criminal liability as a mode of liability under the Malabo Protocol.
