French family law and the European convention on human rights

Abstract

The jurisprudence of the European Court of Human Rights (ECtHR) relating to family law issues is abundant and is a testimony of its interpretative dynamism. The family benefit from the Court’s vigilant but qualified protection. Combined with the jurisprudence of the French Constitutional Court, the compatibility of French family law with fundamental freedoms and rights is guaranteed by judicial review and supervision at both national and European levels.
Following a brief presentation of the relationship between French law and the European Convention of Human Rights, and the reception of the latter by French civil courts, this paper will analyse the development of the jurisprudence of the ECtHR on family law with particular reference to French cases.
